I need you to write a research article. FAMILY LAW Question: Stephen and Emily were married in 2000 and are now both aged 43. They have two children Morgan aged 14 and Aled aged 11. The marriage has not been going well for the last two years. Stephen petitioned for divorced based on Emily’s unreasonable behaviour. The decree nisi is due to be pronounced next week. Emily comes from a very wealthy family who told her that unless she entered into a prenuptial agreement before marrying Stephen, she would be disinherited. The prenuptial agreement was signed 1 week before the wedding and provided that neither party should have to make any financial provision for the other in the event of divorce. Stephen did not take any legal advice. Stephen used to be a successful city stockbroker but was made redundant last year. He is now a fulltime student studying for a degree in history, which he has always been interested in. He is living on his redundancy money which has dwindled to £10,000. Stephen is currently lodging in the home of a fellow student for which he pays rent of £50 per week. He sees the children on a Saturday or Sunday but would like to have them to stay but that is not possible in his current accommodation. Emily is living in the matrimonial home which is in the parties’ joint names. It is a large five bed roomed house in Highgate and is worth £ 2.2 million pounds. Emily is an IT consultant in a software company and apart from working part-time for a couple of years when Aled was a baby, she has worked throughout the marriage and full-time. She currently earns £100,000 per annum. Both parties have pensions, Emily’s is worth around £150,000 and Stephen’s around £300,000. Stephen says that Emily will inherit a very large amount of money when her parents die. She has two siblings and her parents are in their late 70s. Stephen wants to apply for financial provision and seeks your advice on the prospects of success. What type of orders are the court likely to make and on what basis will they make their orders?
