Original Lease dated 12/18/2020 ended 12/18/2021, went month to month, tenant lost job and wasn't paying well, sent an email on 04/06 stating this was written confirmation of our conversation - 55-day notice to vacate, end tenancy 05/31/2022 (provided proof of text, emails and calls - she acknowledged). She has not paid May rent, internet for April, May and June, and same for utilities. I filed eviction but failed to give her 10 day notice, I gave her 5 but that was in MAY. Now that we're in June, per JDF 97 paragraph 4 = No notice to quit shall be necessary from or to a tenant whose term is, by agreement, to end at a certain time. I assume that means I can go straight for eviction on Monday and file the complaint - JDF99, CRCCP Form 3 and CRCCP Form 1A. I would like to have my court documents reviewed. I have a signed lease but the one I'm providing here is not signed (I need to scan and upload signed one) and I don't have a digital copy of the Small Claims doc I filed and had personally served, today. I chose the Small Claims route so she could get personally served so I could get a money judgment and then garnish wages, etc. Please review my documents to take to the County on Monday so I can get this holdover tenant out of my house! Do I also file a JDF 103 and JDF 102? I had the tenant personally served for Small Claims Court so I could get a money judgment - can I get a money judgment for this eviction and not have to proceed with Small Claims?
